HODAG SPORTS CLUB SHOOTING RANGE
PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
In consideration for being permitted to enter, use, or participate in any activities at the Hodag Sports Club Shooting Range (“the Facility”), I hereby agree to the following terms and conditions:
1. Acknowledgment of Risks
I understand and acknowledge that shooting sports involve inherent, significant, and unavoidable risks, including but not limited to:
- Injury, property damage, or death resulting from accidental or intentional discharge of a firearm.
- Injury, property damage, or death caused by ricochets, projectiles, or debris.
- Hearing damage due to high‑decibel gunfire.
- Eye injury from flying brass, fragments, or environmental hazards.
- Lead exposure, noise exposure, and other environmental conditions.
- Weather‑related hazards (for outdoor ranges).
I understand these risks cannot be eliminated, even with safety measures in place.
2. Assumption of Risk
I voluntarily assume all risks, known and unknown, associated with entering the Facility, handling firearms, shooting, spectating, or participating in any activity on the premises.
3. Safety Rules and Compliance
I agree to:
- Wear eye and ear protection at all times while on the range.
- Follow all posted rules, safety protocols, and instructions from Facility staff or Range Safety Officers.
- Immediately comply with any command issued for safety purposes.
- Allow staff to inspect any firearm, ammunition, or equipment for safety concerns.
- Refrain from unsafe behavior and acknowledge that the Facility may remove me from the premises at its sole discretion.
4. Health and Fitness to Participate
I certify that:
- I am not under the influence of alcohol, drugs, or impairing substances.
- I am fully aware of my mental faculties and capable of safely handling a firearm.
- I have no physical or mental condition that would impair safe participation.
- I have not been denied the purchase or possession of a firearm by lawful means.
- I am legally permitted to possess, handle, and discharge a firearm.
- I have not been convicted of a felony involving moral turpitude, domestic violence, or any offense prohibiting firearm possession.
5. Release of Liability
I hereby waive, release, and discharge the Facility, its owners, directors, employees, agents, representatives, volunteers, and affiliates from any and all claims, demands, causes of action, damages, expenses, or liabilities arising from:
- Injury, illness, or death;
- Damage to my property;
- Harm caused by other participants;
- Harm caused by my own actions;
- Harm occurring while participating, spectating, or present on the premises.
This release applies to myself, my heirs, executors, administrators, and assigns.
6. Covenant Not to Sue
I agree that I will not file or initiate any lawsuit or claim against the Facility or its representatives for any reason arising from my presence or participation at the Facility.
7. Indemnification
I agree to indemnify, defend, and hold harmless the Facility and its representatives from any claims, damages, losses, or expenses (including attorney fees) arising from:
- My actions or negligence;
- My violation of Facility rules;
- My use of firearms, ammunition, or equipment;
- Any harm I cause to other persons or property.
8. Emergency Medical Response
I understand that the Facility does not employ medical personnel. I authorize the Facility to secure emergency medical care for me if needed and agree to assume all costs associated with such care.
9. Personal Property
I understand the Facility is not responsible for lost, stolen, or damaged personal items, including firearms, gear, or vehicles.
10. Damage to Facility Property
I agree to be financially responsible for any damage I cause to Facility property, equipment, or structures.
11. Photo and Video Release
I grant permission for the Facility to use photographs or video taken of me for documentation, training, or promotional purposes.
12. Severability
If any portion of this agreement is found unenforceable, the remaining sections shall remain in full force and effect.
13. Governing Law and Venue
This agreement shall be governed by the laws of the State of Wisconsin. Any dispute shall be resolved exclusively in the courts of Oneida County, Wisconsin.
14. Voluntary Participation
I declare that my participation is voluntary, without coercion or inducement, and that I fully understand the risks and terms of this agreement.
